Motorbike Tours Morocco

Complaints and jurisdiction

If the participant feels that Wheels of Morocco have not met its obligations, it should be immediately brought to the attention of the leading tour guide. If however, the participant is not satisfied with the answer or solution provided, any further complaints should be put in writing, within 14 days of the trip’s end date, including the tour date and nature of the complaint to: viki@wheelsofmorocco.ma .
The complaint will be duly investigated by the company management and a full response will be provided within 10 days in writing.
The country of jurisdiction is Morocco, hence any disputes arising will be settled in a competent court of law in Morocco.

Verbal exchanges and arrangements

Any verbal exchanges or arrangements that change the terms and/or the conditions between the participant and Wheels of Morocco can only be considered valid if and when confirmed in writing by Wheels of Morocco.

Weather conditions

Although one of the advantages Morocco can offer is that weather is pleasant for motorcycle rides throughout the year, some of our trips pass through areas where changes in weather conditions can be sudden and dramatic. Wheels of Morocco cannot be made liable for unfavourable weather conditions and no refunds are made for such conditions. We reserve the right to make route modifications as necessary to continue the trip and to accommodate the well-being and safety of the participants.

Force Majeure

Means any unusual and unforeseeable circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care. Such circumstances or events include, but are not limited to terrorist activity, war or threat of war, civil unrest, riots, strikes, breakdowns in public transport infrastructure, closure or congestion of airports, natural disasters like fire, flooding or unexpected adverse weather conditions. In the event of any of the above Wheels of Morocco cannot be made liable and therefore refunds or compensations cannot be requested.

Photo and video material

Any photos and videos taken by Wheels of Morocco whilst on tour remain the copyright of Wheels of Morocco. You also agree that we may use this material for advertising and marketing purposes, including our newsletter, including images in which individual tour members can be recognized.

Damage / safety deposit

We supply the participants with less than 3 years old and fully functional motorcycles as part of the tour package. A safety deposit is payable the start of the tour, which amounts to 3 000 EUR. This can be paid by credit / debit card or cash. This deposit will be returned upon return of the motorcycle in its original condition, except for tyre wear. In the event the rider damages the motorcycle during a tour to the extent it becomes unusable, then the rider may have to finish the tour in the support vehicle. If the support vehicle cannot accommodate the participant due to lack of space, the participant might be required to return back to Wheels of Morocco premises (or the selected hotel in the city of departure) by public transportation. The cost of returning by public transportation will be borne by the participant. Wheels of Morocco will not be held liable for such costs. Wheels of Morocco cannot guarantee that the motorcycle can always be repaired during the tour, hence any damage has to be paid in full.

The participant agrees to assume all responsibility for costs of damage to the motorcycles (and accessories) resulting from negligent and careless riding and/or accidents caused by the participant. In the event of such damage, the cost will be deducted from the participant’s deposit, calculated based on the official BMW parts price list plus 30% shipping and taxes.

Waiver

The participants of the motorcycle trips understand that riding a motorcycle is an activity that can incur risks and that the participant is is aware of these risks. Each participant will be required to sign a waiver to confirm they accept these risks.

Participants are also liable for any damage caused to third parties and agree to waive all claims against Wheels of Morocco and its employees for any personal damages caused during the tour.

Participant’s responsibility and obligations

Participants must be 18 years of age or above and must hold a valid unrestricted motorcycle license in their country of residence issued minimum one year before the rental/tour start date. Participants must adhere to the traffic regulations valid in Morocco and will be liable for any traffic violations they commit while on tour with Wheels of Morocco.

Participants have to wear a helmet at all times while riding. Participants are responsible to adjust their riding style and speed according to road and weather conditions and in consideration of their safety and the safety of others.

Participants cannot allow other than the participant named in the booking form to use the motorcycle.

Participants should not use the motorcycle in a condition unsuitable for driving and should not ride under the influence of alcohol or drugs. Participants cannot consume alcohol during daytime while riding and should refrain from consuming excessive amounts of alcohol that could influence their condition during the trip.

Participants cannot use the motorcycle for any commercial, or non-general touring purposes.

Participants cannot use the motorcycle as security or sell the motorcycle or dispose of the motorcycle or its parts, equipment, accessories and documents in any way that could infringe the rights of ownership of the rightful owner of the motorcycle.

Participants have to advise Wheels of Morocco and its staff of any prescribed medication they take or have to take during the trip or any existing medical condition they have. Although medical infrastructure in Morocco is very good, our trips take us through some remote locations where medical assistance and/or evacuation might be time consuming and needs to be arranged.

Our responsibility

It is our responsibility to provide the services listed in the tour details, our website or social media sites, our brochures, or any promotional material that was created by Wheels of Morocco.

Our contractors (i.e. hotels and other service providers) are regularly reviewed and carefully selected and we strive to ensure they provide the high level standards of Wheels of Morocco.

We are responsible for the planning, preparation and organisation of the tours we propose as well as the guided tour the participant has booked. However, Wheels of Morocco is not liable for accidents occurred during the tour.

The participant acknowledges that Wheels of Morocco, its owners, agents and guides are not liable for the safety of the participants and they cannot be held liable (individually or collectively) for any occurrence (by way of example, but not limited to illness, injury or death) directly or indirectly related to the participation on a tour. Participants, their family, heirs, successors or assignors agree to indemnify, release and hold Wheels of Morocco free from any liability related to the above.

Luggage

We carry one luggage (30l or 50l duffel bag or a cabin sized luggage) for each tour participant in the support vehicle (note: one-day rides and tours with less than 6 riders do not include support vehicles). Items of an immediate or personal nature such as passport, money, camera, personal medication, etc. should be carried by the participant on the motorcycle. Wheels of Morocco does not assume responsibility for any loss, damage to the items carried by the participant, nor for any delay in delivering the luggage to the participants. Any loss, damage or delay of luggage carried by Wheels of Morocco should be covered by the customer’s own travel insurance policy.

Reservation, deposit and payment

Upon reservation, and once your selected tour dates are confirmed, a non-refundable deposit of 30% is payable to Wheels of Morocco by means of credit card, banks transfer. This deposit will secure the participant’s place on the tour and will be deducted from the total payable amount when the participant arrives on the tour. Tour reservations cannot be guaranteed until receipt of the deposit. The remaining 70% of the tour price is payable two months before the tour start date – for private tours final payment is due latest 90 days before start date. If the payment of the 70% is not done in time, the participant space will be cancelled and freed up for another rider – in that case the 30% deposit cannot be used for another tour. The tour prices highlighted on the website, other social media sites, brochures or promotional materials do not include the safety deposit (see Damage / Safety deposit bullet point under Terms & Conditions) payable separately.

If participant wants to change the tour date – that means that the originally booked date/tour should be cancelled and a new booking is made. (Cancellation charges apply)

Minimum tour participation and cancellation by Wheels of Morocco

Wheels of Morocco reserves the right to cancel a tour 30 days prior to the tour date in case an insufficient number of tour participants have booked. In such case, Wheels of Morocco will provide an alternative tour date. If the participant does not accept the alternative date proposed, the amount paid by the participant will be reimbursed in full. Wheels of Morocco is not liable for any additional costs or losses related to the cancellation, which includes but is not limited to airline tickets, hotel reservations or car hire.

Wheels of Morocco will not make any refunds once a tour has commenced, regardless of the reason the participant was unable to begin the tour. Wheels of Morocco advises its customers to take a cancellation insurance from their insurance company to cover for such unexpected events.

Cancellation by participants and refunds

In case of cancellation within 120 days of the tour start date, the fees already incurred by Wheels of Morocco that include, but are not limited to hotel and program reservations, shall not be refunded.

The customer can withdraw from the trip at any time before the start of the trip by a written declaration.  In the event of a cancellation by the customer, Wheels of Morocco can demand flat-rate cancellation costs, which are calculated as follows from the tour price: 

  • from the date of deposit until 90 days before departure: 30 % of the tour price
  • 61-89 days before departure: 40% of the tour price
  • 42-60 days before departure: 50% of the tour price 
  • 28-41 days before departure: 70 % of the tour price 
  • 0-27 days before departure: 100% of the tour price 
To rebook the tour for another date – the originally booked trip needs to be cancelled first and then rebooked to another date.
 

Private tours:

  • from the date of deposit until 150 days before departure: 30 % of the tour price 
  • 90-149 days before departure: 40% of the tour price
  • 60-89 days before departure: 50% of the tour price 
  • 28-59 days before departure: 70 % of the tour price 
  • 0-27 days before departure: 100% of the tour price 
 

Included in tour price

Our multi-day tour prices include a motorcycle (see our bikes section) with insurance, a full time tour guide with motorcycle for the trip duration, assistance vehicle (above 5 riders) for the trip duration, hotel accommodation based on double occupancy (single occupancy requires a surcharge), all breakfasts and dinners during the trip, airport pick-up and drop-off, all parking fees during the tour, all local taxes and road tolls.

Not included in tour price

Our tour prices do not include the cost of participants’ travel costs to and from the tour start location, cost of visas, the cost of fuel, lunches, personal expenses during the tour, drinks and the cost of personal travel and repatriation insurance. Wheels of Morocco reserves the right to refuse access to the tour to all participant who fails to show evidence of such insurance before the start of any tour.

Behaviour

Wheels of Morocco and its designated tour guides have the right to disqualify participants of any tour if and when the participant’s general behaviour endangers the health, safety or welfare of any other participant, passenger, bystander, or any third party, or if the participant’s behaviour impacts the operation and the of the tour.

If the participant does not comply with local traffic regulations or the requirements for group travel as highlighted by Wheels of Morocco during the pre-tour briefing, Wheels of Morocco reserves the right to disqualify the participant from the tour. Any fines or prosecutions will be the sole responsibility of the offending participant and Wheels of Morocco cannot be held liable for such fines or prosecutions in any way.
Participant must obey tour leader’s instructions during the tour to ensure the safety and pleasure of all participants. WoM reserves the right to cancel the participation of any participant –with no refund of the tour price- who does not comply with the instructions of the tour leader and / or endangers the safety of the other participants, or doesn’t have the appropriate skills to safely ride the motorbike on the different surfaces during the tour. In the event of such cancelation the company will repossess the bike and the participant will be able to continue the tour in the support vehicle if possible, or will be made to take alternative transportation back at his own risk and cost, plus customer will be charged for the costs for towing the bike back to offices, and for his transportation costs. There will be no refund of any kind of the tour price.
